Dani Prabowo, Jakarta – The Commission for Missing Persons and Victims of Violence (Kontras) says that only two out of 11 recommendations by the government's Team for the Non-Judicial Resolution of Past Gross Human Rights Violations (TPPHAM) have been followed up on by President Joko "Jokowi" Widodo's administration.
"Of the 11 recommendations that have been submitted to the President, we recorded that only two have been realised", said Kontras Working Body Coordinator Dimas Bagus Arya during a press conference on Thursday June 27.The first recommendation that has been carried out was a statement acknowledging and expressing regret for past human rights violations by the head of state in January 2023.
It should be noted however, that even though the state has acknowledged and expressed regret that past gross human rights violations occurred in Indonesia, President Widodo has been reluctant to apologise to the victims.
"Because there has been neglect by the state in apologising as an effort to take responsibility to protect [the victims] and take responsibility in the context of justice", Arya added.
While the second recommendation that has been fulfilled is the data collection of victims of past gross human rights violations.
"These two things have actually been fulfilled, while the remaining nine recommendations in our opinion have not been fully resolved or implemented comprehensively, because indeed the mandate of the TPPHAM's initial term has expired so there is no authority to oversee the recommendations", he said.The other recommendations that has not been implemented are to restore the victims' rights related to past gross human rights violations.
Then redrafting a balanced history and formulation of events as the state's official historical narrative, while considering the human rights of those who fell victim.
Then there is restoring the victims' rights in two categories, namely their constitutional rights as victims and their rights as citizens.
Strengthening the country's obligations to address the specific rehabilitation of the victims in strengthening national cohesion needs to be carried out as an alternative national harmonisation that is cultural in nature.
Then conducting a re-socialisation of the victims with the wider community. Making state policies to guarantee there is no repetition of these gross human rights violations. As well as building a memorabilia based on adequate historical documents so similar incidents are not repeated.
Furthermore, carrying out efforts to institutionalise and instrumentalise human rights by the ratification of international human rights instruments and enacting a new human rights law.
Finally, building a mechanism for supervising the recommendations submitted by TPPHAM.
