11 regional heads file judicial review of regional head election law

Sharisya Kusuma Rahmanda, Jakarta – At least eleven regional heads submitted a judicial review with the Constitutional Court (MK) regarding Article 201 Paragraphs 7, 8, and 9 of Regional Head Election (Pilkada) Law.

They are the Governor of West Sumatra, Mayor of Bukittinggi, Governor of Jambi, Regent of Pesisir Barat Regency, Regent of Malaka, Regent of Kebumen, Regent of Malang, Regent of Nunukan, Regent of Rokan Hulu, Mayor of Makassar, and Mayor of Bontang.

Citing from media Langgam.id, the lawsuit is represented by the Visi Law Office led by Donal Fariz as legal team coordinator along with Febri Diansyah and Rasamala Aritonang as attorneys.

Donal stated that the request is closely related to the format of the 2024 regional head elections which will be held simultaneously throughout the archipelago. He argued that this would cause various problems and is against the Constitution. One of the consequences is that the terms of office of regional leaders will be significantly shortened, harming 270 regional leaders.

"Nearly half of the total 546 regional heads, or 49.5 percent, are affected," he explained, adding that the eleven regional heads represent the interests of the affected regional heads.

The Visi Law Office raised seven issues for the judicial review, including the potential for increased corruption in the simultaneous presidential elections, legislative elections, and regional elections.

The petitioners requested that the Constitutional Court divide the simultaneous regional head elections into two phases, in November 2024 for 276 regions and in December 2025 for 270 regions, in a bid to prevent further losses.
