Antara, Jakarta – The Panel of Judges of the Central Jakarta District Court sentenced Major General (ret.) Kivlan Zen to four months and 15 days of imprisonment for the case of illegal firearm possession.
"The defendant is sentenced to four months and 15 days in prison," said Chief Justice Agung Suhendro during the verdict hearing on Friday, September 24, 2021.
Zen was found guilty of committing a crime for receiving, and in possession of an illegal firearm and ammunition.
According to the judge, the former Army Strategic Reserves Command (Kostrad) Chief of Staff violated Article 1 paragraph (1) of the Emergency Law No. 12 of 1951 regarding the possession of weapons in conjunction with Article 56 paragraph (1) of the Criminal Code.
"The evidence including one firearm and one rifle is confiscated to be destroyed," said Agung.
The panel of judges considered a number of factors that reduces the sentence, such as Zen had been in charge of a peace mission with the Philippine Government in 1995-1996, served in covert operations, and was involved in the release of Indonesian citizens held hostage in the Philippines.
Meanwhile, factors that weighed heavily on the defendant included the fact that Kivlan Zen sparked public uproar and did not openly admit his actions. The verdict was lower than the prosecutor's demand of seven months imprisonment.
