Prosecutors seek 11-year prison term for doctor accused of raping patients in Indonesia's Bandung

Jakarta – Prosecutors are seeking an 11-year prison sentence for Priguna Anugerah Pratama, a former anesthesiology resident at Hasan Sadikin Hospital in Bandung, West Java, who is accused of raping two patients and a patient's family member.

In addition to the prison term, prosecutors are requesting a fine of Rp 100 million (US$6,031.82) and Rp 137 million in restitution for the victims. The restitution will be divided among the three victims in varying amounts.

If the restitution is not paid, Priguna will face an additional six months in prison. Likewise, failure to pay the Rp 100 million fine would result in another six-month prison term.

Nur Sricahyawijaya, spokesperson of the West Java Prosecutors Office, accused Priguna of violating Article 6 of the 2022 Law on Sexual Violence, which carries a maximum penalty of 12 years in prison and a fine of up to Rp 300 million.

"The defendant's actions have caused significant psychological trauma to the victims, who continue to suffer from the effects of the sexual violence. As a doctor, he should have provided protection and a sense of safety to his patients," Nur said on Monday, as quoted by Kompas.com.

However, prosecutors also took into account several mitigating factors when seeking punishment for Priguna, such as the fact that he allegedly admitted and expressed remorse for his actions, reached a settlement with one of the victims by providing Rp 200 million in compensation and has no prior criminal record.

Priguna, then-student at the Bandung's Padjadjaran University, was arrested on March 23 after allegedly raping a young woman who was accompanying her critically ill father at Hasan Sadikin Hospital.

The first-year anesthesiology resident allegedly lured the woman into an unused room around 1 a.m. on March 18 under the pretense of conducting a blood type crossmatch test. He then reportedly administered the sedative Midazolam to the victim, causing her to lose consciousness.

The victim reported feeling pain in her genital area upon regaining consciousness three hours later and immediately filed a report with the West Java Police.

Subsequent investigations found a used contraceptive allegedly used by Priguna at the unused room, which was later confirmed to match his DNA. Police also discovered his pubic hair at the scene.

Following the case's media coverage, two other female patients at Hasan Sadikin Hospital came forward, alleging they were also raped by Priguna. They claimed he brought them into an unused room at the hospital and administered Midazolam under the pretext of performing allergy tests on anesthetic drugs.

Rachim Dinata Marsidi, President Director of Hasan Sadikin Hospital, stated that the hospital enforces strict protocols for managing pharmaceutical drugs, requiring that anesthetics removed from storage be returned in the exact quantities issued. However, Priguna is reported to have collected leftover anesthetics from previous patients without the hospital's knowledge or approval.
