Derivative law on personal data protection completed, expected to be issued 2024

Tempo - December 6, 2023

Defara Dhanya Paramitha, Jakarta – The Ministry of Communication and Information said that the government had finalized the draft of the derivative rules for the Law on Personal Data Protection (UU PDP). Next, the ministry will form a special committee consisting of ministries/agencies to discuss the derivative regulations.

"The PDP Law has one PP (Government Regulation) and one Presidential Decree. In substance, it means that the draft has been completed," the ministry's Director General of Public Information and Communication, Usman Kansong, said in Jakarta on Monday, December 4.

He said that the draft is now in the process of harmonization. He hopes that regulations derived from the PDP Law can be issued immediately in early 2024, so that cases such as data leaks will not happen again, or at least can be handled firmly and specifically.

"We have sent a letter to the Ministry of Law and Human Rights to form a committee of ministries and institutions to hold further discussions. We will check again to see if there are any new suggestions for the PP or Presidential Decree," he said.

As for the formation of an agency with authority over personal data protection, Usman said that the matter is currently still under discussion.
