Democrats rejects constitution amendment to reinstate GBHN

Budiarti Utami Putri, Jakarta – The Democrat faction head at the People's Consultative Assembly (MPR), Benny Kabur Harman, said that there is no urgency to amend the 1945 Constitution.

He opined the reinstatement of the State Policy Guidelines (GBHN) could be taken through the issuance of law, instead of the amendment.

"[We] do not need to revise the 1945 Constitution only to reinstate GBHN," said Benny to reporters, Wednesday, October 9.

Benny explained Indonesia has actually had GBHN in different terms, namely long-term, medium-term, and short-term development plans. The regulations have been stipulated on laws.

If the policy is considered incomplete or out of date, it could be revised to be more responsive and relevant to current conditions. Benny also added that the law's title possibly to be changed specifically about GBHN.

The name changes could be executed under legislation procedure set in the formation of legislation. Benny insisted that the constitutional amendment is unnecessary. "If the nomenclature is replaced, the law's name can be changed to be about GBHN," he stressed.

The Democrat politician further opined that current state problems did not stem from the constitution, but rather the implementation of the constitution.

He said the newly-appointed MPR should focus on helping the government in dealing with other crucial issues, such as Papua conflict, and how to respond to public demands about the issuance of regulation in lieu of law or Perpu on KPK (Corruption Eradication Commission).
