Amelia Rahima Sari, Jakarta – Prosecutors have charged former Attorney General's Office (AGO) Deputy Attorney General for Special Crimes Febrie Adriansyah with money laundering, alleging that hundreds of billions of rupiah he received came from extortion and gratification.
Prosecutor Agus Sahat Sampe Tua Lumban Gaol told the Jakarta Corruption Court on Wednesday, October 7, that Febrie received money, shares, and property allegedly linked to corruption while he served as the AGO's Director of Investigation and later as Deputy Attorney General for Special Crimes.
"The total money received amounted to Rp346.74 billion and US$440,990, along with shares, land and/or buildings, which the defendant knew or should have suspected were proceeds of corruption," Agus said during the hearing.
Prosecutors detail alleged payments
Lawyer Don Ritto and businessman Nurman Herin are also defendants in the case and face money laundering charges. Businessman Ferry Yanto Hongkiriwang, meanwhile, has been designated as a protected witness by the Witness and Victim Protection Agency (LPSK).
According to Agus, the alleged payments were connected to Febrie's duties, authority, and positions at the AGO.
One of the alleged payments came from property businessman Tan Kian. Prosecutors alleged that the money was paid to prevent Tan Kian from being named a suspect in the corruption case involving the Armed Forces Social Insurance (ASABRI), which was being investigated by the AGO.
"The Rp55 billion received from Tan Kian through Ferry Yanto Hongkiriwang was proceeds of the criminal act of extortion," Agus said.
Febrie was charged under Article 12(e) of the 1999 Anti-Corruption Law, as amended by Law No. 20 of 2001, which covers extortion.
He was also charged under Article 12B of the Anti-Corruption Law concerning gratification deemed to constitute bribery.
Prosecutors detailed the alleged receipts as follows:
Shares worth Rp14 billion from Michael Njoman, the owner and director of PT Cahaya Baja Sukses, through Ferry Yanto Hongkiriwang.
Rp20.6 billion from Tria Bellitonito Aturbumi, president director of PT Oktasan Baruna Persada.
Rp60 billion, along with land and buildings, from Andy Chandra Tan, the beneficial owner of PT Budi Agung Sentosa, and Heri Janto, the company's president director, through Don Ritto and Nurman Herin using PT Kresna Pusaka Energi.
Rp203.47 billion from other parties, which prosecutors alleged was connected to corruption cases handled by Febrie while he served as Director of Investigation and Deputy Attorney General for Special Crimes.
Prosecutors allege money was concealed
Agus alleged that Febrie and his associates concealed the money by depositing and transferring funds into several accounts that appeared to be used as business capital for affiliated companies.
The funds were also allegedly used to purchase assets, including land and buildings.
"The defendant, acting either alone or together with Don Ritto, Nurman Herin, and Ferry Yanto Hongkiriwang, did so with the purpose of concealing or disguising the origins of the assets," Agus said.
Febrie was also charged under Article 607(1)(a) or Article 607(1)(b) of the Criminal Code, in conjunction with Article 20(1)(c) and Article 127(1) of the Criminal Code.
Following the reading of the indictment, Febrie's lawyer, Febri Diansyah, said the defense would file an objection, or exception, to the charges.
He said several matters that emerged during the investigation had been presented differently in the indictment.
"Honestly, we see many problems in the indictment that we have received," he said.
