The demand was presented during a hearing at the Central Jakarta District Court on Friday, February 27, 2026.
In court, prosecutors asked the panel of judges to find Delpedro, along with Muzaffar Salim, Syahdan Husein, and Khariq Anhar, guilty of incitement under Article 246 in conjunction with Article 20C of Law No. 1 of 2023 on the Criminal Code (KUHP).
"Therefore, we request that the court impose a two-year prison sentence on defendant one Delpedro Marhaen, defendant two Muzaffar Salim, defendant three Syahdan Husein, and defendant four Khariq Anhar," the prosecutor said.
The prosecution also requested that any eventual sentence be reduced by the time the defendants have already spent in detention. In addition, prosecutors asked the court to order their placement in a state detention center. The four are currently under city detention status.
The defendants are accused of incitement during a wave of demonstrations in August 2025. Prosecutors alleged that they disseminated provocative content on Instagram through several accounts, including @aliansimahasiswapenggugat, @gejayanmemanggil, and @lokataru_foundation.
According to the indictment, the four uploaded social media content "with the intention of inciting hatred or hostility toward the government."
In addition to the Criminal Code provisions, they were charged under Article 28(3) in conjunction with Article 45A(3) of Law No. 11 of 2008 on Electronic Information and Transactions (ITE), as most recently amended by Law No. 1 of 2024, in conjunction with Article 55(1) of the Criminal Code.
Prosecutors also cited Article 160 of the Criminal Code in conjunction with Article 55(1), as well as Article 76H in conjunction with Articles 15 and 87 of Law No. 35 of 2014 on Child Protection, which amended Law No. 23 of 2002, also in conjunction with Article 55(1) of the Criminal Code.
