Amelia Rahima Sari, Jakarta – The All-Indonesia Workers Union Confederation (KSPSI) in a written statement on Tuesday accuses President Joko "Jokowi" Widodo of betraying the constitution by ratifying the government regulation in lieu of law on Job Creation (Perppu Cipta Kerja). The confederation believes the President's move has violated Constitutional Court (MK) ruling.
The Constitutional Court verdict dated November 25, 2021, stated that the Job Creation Law must be fixed by repeating the formulation procedure, mainly by taking in public aspiration. However, KSPSI laments the fixes that have not been implemented after roughly a year.
"If there were good intentions, from the time the Constitutional Court produced the verdict, the Government and the DPR (House of Representatives) could have immediately made improvements," KSPSI said in a written statement on January 3.
Furthermore, KSPSI said the Constitutional Court's decision was an official decision of a State High Institution that was not implemented by President Jokowi. KSPSI also considers the President has betrayed the constitution because formally, the Job Creation Perppu clearly violates the procedure for issuing a government regulation in lieu of law.
KSPSI believes that the Constitutional Court's decision essentially states that the Job Creation Law must be revised, not replaced with a new Perppu that has similar substance to the Job Creation Law.
"On the contrary, the issuance of Perppu No 2/2022 concerning Job Creation, proves that the President is more devoted to the interests of the Oligarchy/Investors/Entrepreneurs than the interests of the people by arguing that there is a pressing emergency," their statement reads.
