PKS proposes options to approve Sexual Violence Bill

Maya Ayu Puspitasari, Jakarta – The Prosperous Justice Party (PKS) faction said it would approve the sexual violence crime bill or RUU TPKS on conditions that the bill is ratified along with the criminal code (KUHP) bill.

Almuzzammil Yusuf, a member of the working committee (Panja) of the bill from the PKS faction, said the criminal code bill has completed the regulations of the prohibition of adultery and LGBT (lesbian, gay, bisexual, and transgender).

The criminal code bill is also a carry-over bill from the previous period, but to date the discussions between the Legal Commission of the House of Representatives (DPR) and the government has not yet commenced. "So this bill has no legal force yet," said Muzzammil on Monday, January 17.

PKS is still refusing to approve the sexual violence bill. According to Muzzammil, there should be three sexual issues regulated in the bill, viz. sexual violence, sexual freedom, and sexual deviation. "The bill only discusses sexual violence," he said.

The Islamic conservative party thus concluded that non-violent adultery and LGBT would be no problem according to the bill.

PKS also suggested another option: taking the ban on adultery and LGBT noted in the criminal code bill to be included in the sexual violence bill.

"The PKS faction will approve RUU TPKS if one of the two options is taken by the DPR and the government so that it does not carry the consequences of sexual consent which tends to be permissive in matters of sexual relations. This is clearly not in line with Pancasila and our constitution," Muzzammil underlined.

The discussions of the sexual violence bill at the House's Legislative Body level has finished. It is planned to be passed as the House's initiative during the upcoming plenary session on January 18, 2022. After that, the bill will be submitted to the government to obtain a response in the form of a problem inventory list (DIM).
