Anies Baswedan forced to revoke IMB for reclaimed islet

M Yusuf Manurung, Jakarta – A public attorney from the Jakarta Legal Aid (LBH) institution Ayu Eza Tiara, mentioned that there were dozens of procedures that must be taken before Jakarta Governor Anies Baswedan can issue building permits (IMB) for one of the islets of the Jakarta reclamation project.

Ayu was referring to the issuance of IMB on behalf of Kapuk Naga Indah, the developer of D Islet, or currently known as Pantai Maju.

Procedures needed to issue IMB includes the preparation or adjustment to national spatial planning, Jakarta spatial planning, Jakarta north coast strategic area spatial planning, and zoning plan on coastal areas and small islands (RZWP3K).

Moreover, there are provisions on environmental impact analysis (Amdal), environment permit, principal permit, and reclamation establishment permit.

"After that, a land-use right permit and a right-to-use permit (HGB) can be issued, and the last is IMB," said Ayu during a press conference in LBH Office on Friday, June 21, 2019.

As part of the lengthy procedure, Ayu added, the city administration has yet to comply with the Regional Decree on RZWP3K, detailed spatial planning, Amdal, and environment permit, while HGB certificate for reclamation islands was being challenged by The Save Jakarta Bay Coalition in the court.

Ayu further added that former Governor Basuki Tjahaja Purnama was taking 'shortcuts' to be able to issue Jakarta Gubernatorial Decree No. 206/2016 on the reclamation project.

Consequently, the policy was not legally binding. Nevertheless, Anies Baswedan used the questionable policy as a legal basis to issue the IMB.

Therefore, Ayu insisted that the IMB for PT Kapuk Naga Indah was a defect administration. "So the IMB must be revoked."
