Apindo to sue Anies Baswedan over revised policy on minimum wage

Lani Diana Wijaya, Jakarta – The Indonesian Employer Association (Apindo) chairman Hariyadi B. Sukamdani planned to file a lawsuit against Jakarta Governor Anies Baswedan to the Jakarta State Administrative Court (PTUN) concerning matters related to the revised regulation on the 2022 provincial minimum wage (UMP).

"Once the Gubernatorial Regulation [Pergub] is issued, we will go to PTUN," said Hariyadi in an online press conference, Monday, December 20, 2021.

Last Saturday, Anies announced that the increase in the city's minimum wage for 2022 would be adjusted to IDR 225,667 or 5.11 percent. Consequently, the 2022 UMP would be IDR 4,641,854.

Previously, the increase was set at 0.85 percent or equals to IDR 37,749 of this year's figure to IDR 4,453,935.

Hariyadi asserted that the governor had violated government regulations, viz. Government Regulation (PP) No. 36 of 2021 concerning wages.

The increase in wages by IDR 37,749 was in accordance with the calculation formula for UMP as regulated in PP 36/2021. The problem, Haryadi continued, was in Anies Baswedan who suddenly adjusted the amount of the minimum wage increase without a clear legal basis.

"In PP 36/2021, we do not recognize adjustment. If it has been decided, then it is decided and we comply with it," said Haryadi.
