Workers union slam Job Creation Perppu as 'ruse for investors'

Riani Sanusi Putri, Jakarta – The Indonesian Workers Union Association (Aspek) on Monday once again asserted its position against the government regulation in lieu of law on Job Creation (Perppu Cipta Kerja) No. 2/2022, which will effectively replace the publicly criticized Job Creation Law.

The Perppu issued by President Joko "Jokowi" Widodo on December 30th, 2022, was announced by Economic Affairs Coordinating Minister Airlangga Hartarto. The Minister elaborated that it was crucial to answering global economic and geopolitical uncertainty.

Aspek president Mirah Sumirat says that both the government and House of Representatives (DPR) had failed to answer the Constitutional Court (MK) verdict which deemed the Job Creation law 'legally flawed.' MK initially required the government and legislators to implement fixes to the Cipta Kerja within two years, but instead issued a regulation in lieu of law.

"This is a ruse to impose the interests of investors," Sumirat wrote in a statement on January 2.

Aspek officially demands the government revoke the Perppu and urged the government to replace a Perppu that would annul the Job Creation Omnibus and reinstate the law that preceded it. The workers union association argues this is crucial to guarantee Indonesians' right to welfare and legal certainty.

In studying the content of the government's regulation in lieu of law, Mirah said the draft only contained a copy-paste of the Job Creation Law that had been widely criticized by members of the public.

"Even though there are editorial differences, its content has turned even more unclear and there were no fixes, in terms of what workers' unions had demanded," said Mirah Sumirat.
